Fireclay Partners (“Fireclay,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in connection with our website at fireclaypartners.com (the “Site”) and our business activities, including our outreach to prospective clients and transaction participants. By using the Site or communicating with us, you agree to the practices described here.

Fireclay Partners is a veteran-owned investment banking and mergers & acquisitions advisory firm based in Kansas City, Missouri. We provide advisory services to businesses and their owners in connection with sale, acquisition, capital-raising, and related transactions.

Information you provide to us. When you contact us through the Site, by email, or by phone — or in the course of a potential or actual engagement — we may collect your name, business email address, phone number, company name, job title, the content of your message, and any other information you choose to share.

Information collected automatically. When you visit the Site, we and our service providers may automatically collect certain technical and usage data, including your IP address, browser and device type, pages viewed, referring URLs, and access times. We collect this through cookies and similar technologies, including web analytics services (such as Google Analytics).

Website visitor identification. We use a third-party website visitor identification tool provided by Apollo.io. This tool places a script on the Site that sets a cookie and collects information such as your IP address and the pages you view, and matches that information against Apollo’s business database to identify the company — and, in some cases, the individual — associated with a visit. We use this information for business development and to prioritize outreach to businesses that may benefit from our services.

Information from third parties. In the ordinary course of our business, we obtain business contact information about professionals — such as name, title, company, business email, and business phone — from third-party business data providers (for example, Apollo.io) and from publicly available sources. We use this information for business development and outreach in a professional, business-to-business context relating to transactions that may be relevant to the recipient’s company or role.

3. How We Use Information

We use personal information to:

  • Respond to inquiries and communicate with you;
  • Provide, manage, and perform our advisory services and engagements;
  • Conduct business development and outreach regarding relevant transaction opportunities;
  • Identify and prioritize businesses visiting the Site;
  • Operate, maintain, secure, and improve the Site;
  • Detect, prevent, and address fraud, security issues, and misuse;
  • Comply with applicable legal, regulatory, and professional obligations, and maintain records; and
  • Establish, exercise, or defend legal claims.

Legal bases (for individuals in the EEA/UK). Where applicable law requires a legal basis, we rely on our legitimate interests in operating and promoting our advisory business (including B2B outreach and website visitor identification), your consent (where required), the performance of a contract, and compliance with legal obligations.

4. How We Share Information

We may share personal information with:

  • Service providers that support our operations, such as website hosting (e.g., GoDaddy), web analytics, website visitor identification (Apollo.io), email, and customer-relationship and outreach tools, under obligations of confidentiality;
  • Professional advisors, such as our attorneys and accountants;
  • Transaction participants, where necessary to provide our services and consistent with applicable confidentiality obligations and your direction;
  • Legal and regulatory authorities, where we believe disclosure is required by law or necessary to protect our rights, safety, or property; and
  • A successor entity in connection with a merger, financing, acquisition, or sale of assets.

We do not sell your personal information for money. We do use third-party analytics and website visitor identification providers, as described in Sections 2 and 5, which involve disclosing certain information (such as your IP address and browsing activity) to those providers. Depending on your state of residence, some of these activities may be considered a “sale” or “sharing” of personal information under applicable law; you may opt out as described in Section 6.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember preferences, understand how the Site is used, and identify businesses that visit us. This includes web analytics services and the Apollo.io website visitor identification script, which sets a cookie in your browser. You can control cookies through your browser settings, and where required we provide a cookie-preferences tool on the Site so you can accept or decline non-essential cookies. Some browsers offer a “Do Not Track” signal; because there is no common industry standard, we currently do not respond to such signals.

6. Your Choices and Rights

Opting out of outreach. You may ask us to stop contacting you at any time by replying to any message with “STOP,” or by emailing us at admin@fireclaypartners.com. We honor opt-out requests promptly and maintain an internal do-not-contact list.

Cookies and tracking. You may decline non-essential cookies through our cookie-preferences tool (where available) or your browser settings, which will limit analytics and website visitor identification.

U.S. state privacy rights. Depending on your state of residence (including California and other states that have enacted comprehensive privacy laws), you may have the right to request access to, correction of, or deletion of your personal information; to know how your information is used and disclosed; to opt out of the “sale” or “sharing” of personal information or targeted advertising; and to not be discriminated against for exercising these rights. When information is no longer needed, we delete or de-identify it.
